Welcome to 49 Sundays (the "App" and the website at 49sundays.com, together the "Service"). These Terms of Use (the "Terms") form a legal agreement between you (the "User" or "you") and the 49 Sundays team ("we," "us," or "49 Sundays").

By downloading, installing, signing in to, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Please read these Terms carefully. Sections you should pay particular attention to are Section 4 (Important disclaimer), Section 9 (Purchases & subscriptions), Section 10 (Disclaimers and limitation of liability), and Section 14 (Governing law and dispute resolution).

What 49 Sundays is: 49 Sundays is a personal reflection tool for iOS and Android. It estimates, based on U.S. Social Security Administration Period Life Tables and the visit frequency you provide, how many more times you are statistically likely to see a given person in your life. It offers a weekly "Sunday Ritual," a private journal for notes attached to the people you've added, optional reminder notifications, and (for Pro users) longer-form reflection and printable Sunday Letter Books and Sunday Posters.

What 49 Sundays is not: 49 Sundays is not a medical, psychological, actuarial, or insurance service. It does not diagnose any condition, does not predict any individual's lifespan, and is not a substitute for professional advice. See Section 4.

2. Eligibility

You may use 49 Sundays only if all of the following are true:

Regional age requirements: If you are located in India, the Digital Personal Data Protection Act 2023 treats anyone under 18 as a child requiring verifiable parental consent. If you are under 18 and in India, you should use 49 Sundays only with the involvement of a parent or guardian.

49 Sundays is a reflection tool that touches on mortality and finite time with the people you love. We do not think it is appropriate for young users regardless of legal minimums. If you do not meet these eligibility requirements, please do not use the Service.

3. Your account

3.1 Creating an account

49 Sundays requires an account so that your people, ritual responses, and journal entries can sync across your devices. You may create an account in one of three ways:

You may create only one account for your personal use. You may not sell, rent, or transfer your account to anyone else, or let another person use it.

You can delete your account at any time from Settings → Account → Delete account inside the App, or by emailing hello@49sundays.com. See Section 13 for what happens to your data.

4. Important disclaimer (please read this carefully)

4.1 49 Sundays is a reflection tool, not a forecast

49 Sundays is a reflection and lifestyle tool intended to invite intentional thought about the time you have with the people you love. It is not a medical, psychological, actuarial, financial, insurance, or end-of-life service.

The numbers the App shows are computed from U.S. Social Security Administration Period Life Tables (2021) applied to the age, sex, and country you (or the people you add) provide, together with the visit frequency you choose. These tables describe population averages, not individual outcomes. Real lives are shaped by genetics, behavior, accident, and grace — none of which a table can know.

4.2 Do not use 49 Sundays to make consequential decisions

Do not use 49 Sundays to make medical, financial, legal, insurance, or end-of-life decisions for yourself or anyone else. Always consult a qualified professional for those.

4.3 Use the App with care toward others

The Sunday Ritual and the "People" features ask you to enter information about other human beings — their age, your visit frequency, your private reflections about them. Use this responsibly.

4.4 If you are in crisis

4.5 Your responsibility

You are solely responsible for how you use, interpret, and act on the information 49 Sundays displays. We are not responsible for emotional reactions, decisions, or actions you or others take in response to anything shown by the App.

5. License to use 49 Sundays

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use 49 Sundays on a compatible iOS or Android device that you own or control, solely for your personal, non-commercial reflection. This license is subject to your compliance with these Terms.

We retain all rights, title, and interest in and to the Service, including the design, brand, copy, source code, and all intellectual property rights. Nothing in these Terms transfers any ownership to you.

The underlying life-expectancy data is U.S. SSA public data. The concept is inspired by Tim Urban's essay The Tail End. You may share screenshots of your own results, ritual cards, and reflections freely. Please do not copy our design, brand, source code, or copy for your own product.

7. Your content and data

7.1 You own your content

The names, ages, visit frequencies, ritual responses, journal entries, photos, and other information you enter into 49 Sundays are your content. We do not claim ownership of it.

By using the Service, you grant us a limited, worldwide, royalty-free license to host, store, transmit, process, and display your content solely as necessary to operate the Service for you (for example: to render your dashboard, to encrypt your journal, to generate your weekly Sunday Ritual prompt via the AI flow described in our Privacy Policy, to print a Letter Book you've ordered). This license ends when you delete the content or your account.

7.2 You are responsible for accuracy and consent

Your journal entries are encrypted at rest using AES-256-GCM (see our Privacy Policy for details). We do not provide a self-service export of all your data inside the App today; if you would like a copy of your data, email hello@49sundays.com and we will send it in a portable JSON format within 30 days.

8. Third-party services

49 Sundays uses third-party services to function, including:

Your use of these services through 49 Sundays is also subject to their respective terms and privacy policies. We do not control these third parties and are not responsible for their acts or omissions. The categories of data shared with each provider are listed in our Privacy Policy, Section 7.

The App is distributed through the Apple App Store and the Google Play Store, and your installation of the App is also subject to those stores' respective terms of service.

9. Purchases & subscriptions

9.1 Free tier and paid tiers

49 Sundays is free to download and free to try with a limited number of people. The following paid tiers are available:

Prices are shown in your local currency on the Apple App Store or Google Play and may differ slightly from US$4.99 / US$19.99 due to currency conversion and store-defined regional pricing.

9.2 Where the money goes

In-app purchases are processed by Apple StoreKit (iOS) or Google Play Billing (Android). Your card number, billing address, and Apple ID / Google account password are handled by Apple / Google. We receive only an anonymized purchase receipt confirming the entitlement.

9.3 Auto-renewal of the Pro subscription

The Pro subscription renews automatically at the end of each one-year period at the then-current price unless you cancel. You can cancel at any time in your Apple ID subscriptions (Settings → [your name] → Subscriptions) or your Google Play account (Play Store → Account → Subscriptions). Cancellation takes effect at the end of the current billing period.

9.4 Refunds

Refunds for in-app purchases are handled by Apple and Google under their respective refund policies, not by us. If you believe you are entitled to a refund, please request it directly from the store where the purchase was made. We may, at our discretion and where the store policy permits, also process a goodwill refund for the Lifetime unlock within 14 days of purchase.

10. Disclaimers and limitation of liability

10.1 The Service is provided "as is"

To the maximum extent permitted by applicable law, 49 Sundays is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including but not limited to:

10.2 Limitation of liability

To the maximum extent permitted by applicable law, in no event shall the 49 Sundays team, its members, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for:

arising out of or related to your use of (or inability to use) 49 Sundays, even if we have been advised of the possibility of such damages.

Aggregate cap: Our total cumulative liability to you for all claims arising out of or related to these Terms or your use of 49 Sundays shall not exceed the greater of (a) fifty US dollars (US$50) or (b) the amount you have paid us in the twelve (12) months preceding the event giving rise to the claim.

10.3 Mandatory consumer protections

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, you may have rights that override the disclaimers and limitations in this Section 10. Where this is the case, those rights prevail to the extent required by law, and the rest of these Terms continues to apply.

11. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the 49 Sundays team and its members, contractors, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

12. Updates and changes

12.1 Updates to the App

We may release updates, patches, or new versions of 49 Sundays from time to time. Some updates may be installed automatically through the App Store / Play Store. We may modify, add, or remove features, or change the App's behavior, at any time. We will not remove a feature you have already paid for under your current tier without offering a refund or substitute, unless required by law.

12.2 Changes to these Terms

We may revise these Terms from time to time. When we do:

Your continued use of 49 Sundays after a Terms update means you accept the updated Terms. If you do not accept the updated Terms, you must stop using the Service and may close your account.

13. Termination

13.1 Termination by you

You may stop using 49 Sundays at any time. To fully close your account, delete it from Settings → Account → Delete account inside the App or email hello@49sundays.com. Account deletion removes your people, ritual responses, journal entries, and other account data within 30 days (small operational backups may persist up to 90 days, then are overwritten — see the Privacy Policy for details).

Lifetime unlocks and active Pro subscriptions are tied to your account; if you delete your account, you forfeit access to those entitlements and will not receive a refund of any portion of an already-billed subscription period unless required by applicable law.

13.2 Termination by us

We may suspend, restrict, or terminate your access to 49 Sundays (in whole or in part) at any time, with or without notice, if:

If we discontinue 49 Sundays entirely, we will provide reasonable advance notice and, where possible, an option to export your data.

13.3 Effect of termination

Upon termination, the license granted in Section 5 ends immediately. The following sections survive termination: Section 4 (Important disclaimer), Section 7 (Your content and data), Section 10 (Disclaimers and limitation of liability), Section 11 (Indemnification), Section 14 (Governing law and dispute resolution), and any other provision that by its nature should survive.

14. Governing law and dispute resolution

14.1 Governing law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

14.2 Disputes — courts

Subject to Section 14.3, any dispute, claim, or controversy arising out of or related to these Terms or your use of 49 Sundays shall be subject to the exclusive jurisdiction of the courts of Singapore.

14.3 Optional arbitration (at our election)

For any dispute where the amount in controversy exceeds US$10,000, we may elect to resolve the dispute by binding arbitration administered by the Singapore International Arbitration Centre (SIAC) in accordance with its rules then in force. The seat of arbitration shall be Singapore, the language shall be English, and the tribunal shall consist of a single arbitrator. The arbitration award shall be final and binding on the parties.

14.4 Mandatory consumer rights

If you are a consumer protected by the mandatory laws of your country of residence (for example, in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protections), you may also be entitled to bring proceedings in the courts of your country of residence, and to rely on the consumer protection laws of that country. Nothing in this Section 14 deprives you of those rights.

15. General provisions

15.1 Entire agreement

These Terms, together with our Privacy Policy and any additional terms we present for specific features (such as Phase 3 physical orders), constitute the entire agreement between you and us regarding the Service. They supersede any prior agreements between us on this subject.

15.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 No waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

15.5 Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, network or power failures, or government action.

15.6 Headings and interpretation

Section headings are for reference only and do not affect interpretation. The word "including" means "including without limitation."

15.7 Language

These Terms are written in English. Any translation is provided for convenience only. If there is a conflict between the English version and a translation, the English version prevails.
